Terms of Service

By commissioning me you're accepting the following:1. Commissioning Process
a. Beginning
- To start the commission a 50% of the price is paid upfront and is not refundable.
b. Sketch Stage
- The sketch stage will begin. The client will be getting a sketch and can ask for any changes in this part.
c. Lineart and Shading
- After the sketching stage is completed and a sketch is accepted, lineart and shading stage will begin. In this stage any major adjustments have a maximum of five changes before adding a fee for each one. Fee for each adjustment is 10% of the commission price, any minor adjustment is okay. Major adjustments meaning: affecting the lineart or position. Minor adjustment meaning: color change.
d. Final Stage
- When the lineart and shading stage is completed, the client will receive a sample of the artwork. If everything is okay and no changes are needed, client will send the other 50% of the commission price. After the payment is received, client will receive the full size and resolution artwork, completing the commissioning process.
e. Queue and Slots
- If an artwork is being commissioned by a client and another client asks for a commission, a position in the queue is applied to that person with a 50% of the commission price upfront, adding that client to a slot in the queue.2. Payment Method
a. PayPal
- Every payment will be made via PayPal and only to the PayPal account provided by Nyndart (me) unless both parties agree on another payment method.
b. Fee
- The client should and will always pay for the PayPal fee for the transaction. PayPal fee for the transaction being 5.4% plus 0,30$ per transaction of the commission price.3. Warlock Patron Contract
a. Exclusiviness
- Client will not make any patron contract with any other Archfey, Celestial, Fathomless, Fiend, Genie, Great Old One, Hexblade, Undead, Undying, Lurker, Noble, Raven Queen, Seeker or any other entity, deity or God.
b. Expiration
- The expiration date is one hundred (100) years after the last commission bought by the client.
c. The patron contract can only be expired by the time limit set in the heading 3, section b. The only exception for the patron contract to be expired is by the death of the client.
d. Renewal
- Patron contract can be renewed every time a commission is bought from Nyndart (me).
e. Upon Expiration of the Patron Contract
- If the contract is not renewed by the expiration date, the client soul is retrieved from the death and brought back to life to a new body for the client to buy a commission from Nyndart (me) and serve for the rest of one (1) lifetime.
f. Upon Breaching the Patron Contract
- If the terms of the patron contract are breached the client will suffer for the consequences, those being heading 3, subheading e, just after "If the contract is not renewed by the expiration date".
g. Retroactivity
- This patron contract is retroactive for any other commission that has been bought from Nyndart (me) before.
h. Declination of the Patron Contract
- This patron contract can be declined. If the client doesn't make an statement on not wanting to agree on this patron contract it applies on the agreement of a commission.4. Commercial Use
a. What is it?
- Commercial use refers to any use of the commissioning artwork for purposes that are primarily intended for or directed toward commercial advantage or monetary compensation. Those can be direct or indirect comercial use.
b. Direct
- Direct commercial use include: advertising campaigns, product branding, merchandise, product packaging, billboards, websites, book covers and social media posts.
c. Indirect
- Indirect commercial use include: buisness presentations, conference and meetings, research papers, anything that is not directly monetized but contributes to brand recognition.
b. Agreement for Commercial Use
- To be able to use the commissioned artwork for direct or indirect commercial advantage a fee must be applied and agreed between Nyndart (me) and the client.5. Personal Use
a. What is it?
- Personal use refers to any use of the commissioning artwork for purposes outside of monetary gain.
b. Permission
- The client can use this artwork for personal social media, print it for non-monetary purposes, criticism, commentary or anything that doesn't bring any monetary gain from the commissioned artwork.
